These Terms of Service ("Terms") govern your use of Wine Night (winenight.fun, the "Service"). By using the Service you agree to these Terms. If you don't agree, don't use the Service.
1. Eligibility
You must be of legal drinking age in your country (18 or 21+ depending on jurisdiction) to use Wine Night. By using the Service you confirm that you meet this requirement.
2. Your account
You are responsible for keeping your account credentials secure and for all activity on your account. Notify us immediately at support@winenight.fun if you suspect unauthorised access.
You may delete your account at any time from within the app. Deletion is permanent and removes your tasting history.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to access other users' accounts or sessions without authorisation.
- Probe, scan, or test the vulnerability of the Service.
- Use automated tools to scrape or excessively query the Service.
- Upload content that is offensive, defamatory, or infringes third-party rights.
- Reverse engineer, decompile, or otherwise attempt to derive source code.
We may suspend or terminate accounts that violate these rules, with or without notice.
4. Pricing & payments
Wine Night uses a freemium model:
- Free tier: One hosted tasting per account.
- Single Tasting: $2.99 USD, one-time payment for one additional hosted tasting.
- Pro Monthly: $4.99 USD per month for unlimited hosted tastings.
- Pro Annual: $39.99 USD per year for unlimited hosted tastings.
Joining a tasting is always free, regardless of your subscription status.
Payments are processed by Stripe. By making a payment you agree to Stripe's consumer terms.
5. Subscriptions
Pro Monthly and Pro Annual subscriptions automatically renew at the end of each billing period unless cancelled. You can cancel at any time and will retain Pro access until the end of your current billing period.
To cancel, contact support@winenight.fun or use the link in your Stripe billing email.
6. Refunds
All payments are non-refundable except where required by law. If you believe you've been charged in error, contact support@winenight.fun within 14 days and we will review case-by-case.
7. Content & intellectual property
You retain ownership of all data you submit (wine entries, scores, tasting notes). You grant Wine Night a non-exclusive licence to store, process, and display this data as required to operate the Service, including sending anonymised data to third-party AI providers (Google Gemini) to generate tasting summaries.
The Wine Night brand, logo, app design, and source code are the property of Wine Night.
8. AI-generated content
Group summaries and taster profiles are generated by Google's Gemini AI. AI output may occasionally be inaccurate, incomplete, or unexpected. Wine Night provides this content "as is" and is not responsible for the contents of AI-generated text.
9. Service availability
We aim for high availability but cannot guarantee the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue any part of the Service at any time.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, Wine Night and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Total aggregate liability for any claim shall not exceed the greater of $50 USD or the amount you paid Wine Night in the prior 12 months.
12. Indemnification
You agree to indemnify Wine Night against any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.
13. Privacy
Our handling of your data is described in our Privacy Policy, which is incorporated into these Terms by reference.
14. Changes to these Terms
We may update these Terms occasionally. Material changes will be communicated via the app or email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of the jurisdiction in which Wine Night is operated, without regard to conflict-of-law provisions. Disputes will be resolved in the courts of that jurisdiction.
